1. Introduction

Welcome to EchoPastel ("we," "our," or "us"). By accessing or using our website, application, and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

EchoPastel is a SaaS platform that allows users to create, manage, and store "Echos" (the "Service"). We offer both free and paid plans, including Pro (monthly/yearly) and Lifetime access options.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to the Service.

You are responsible for all activities that occur under your account.

4. User Content

You retain ownership of any content, files, or data you upload ("User Content") to EchoPastel. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that its use does not violate any laws or third-party rights. We reserve the right to remove any User Content that violates these Terms.

5. Subscriptions and Payments

5.1. Free Plan

We offer a Free plan with limited features (e.g., maximum of 2 active Echos). We reserve the right to modify the limits of the Free plan at any time.

5.2. Paid Plans (Pro)

The Pro plan offers additional features, including API access and unlimited Echos. You can subscribe on a monthly or yearly basis.

  • Billing: You authorize us to charge your payment method for the subscription fee on a recurring basis.
  • Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period. We do not provide refunds for partial billing periods.

5.3. Lifetime Deal

We may offer a "Lifetime" plan for a one-time fee. "Lifetime" refers to the lifetime of the Service. If EchoPastel ceases operations, the Lifetime plan will terminate. This plan is non-refundable after 14 days from purchase, provided you have not significantly used the Service.

5.4. Price Changes

We reserve the right to change our pricing at any time. Any price changes for existing subscriptions will take effect at the start of the next billing cycle upon notice to you.

6. Prohibited Conduct

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe upon the rights of others, including intellectual property rights.
  • Upload viruses, malware, or any other malicious code.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to the Service or related systems.

7. Intellectual Property

EchoPastel and its original content, features, and functionality are and will remain the exclusive property of EchoPastel and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EchoPastel.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

9. Limitation of Liability

In no event shall EchoPastel, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall our total liability to you exceed the amount you have paid to us in the last 12 months, or $100, whichever is greater.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will verify to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
